Filing a DMCA Complaint

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our website, please notify our designated DMCA Agent. The notice must include the following information to be considered valid under the DMCA:

  1. Identification of the copyrighted work: Please provide a description of the copyrighted work that you claim has been infringed.
  2. Identification of the infringing material: Please provide a description of where the material that you claim is infringing is located on the site. The URL or other identifying information must be included.
  3. Contact Information: Please provide your address, telephone number, and email address so that we can contact you about your complaint.
  4. A statement of good faith: Include a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy: Include a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
  6. Signature: A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.

Response to DMCA Complaints

Upon receipt of a valid DMCA notice, we will:

  1. Remove or disable access to the allegedly infringing material.
  2. Notify the user who posted the material that we have removed or disabled access to it.
  3. Terminate repeat infringers’ accounts where applicable.

Counter-Notification

If you believe that the material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our DMCA Agent. To be effective, a counter-notification must include the following:

  1. Identification of the removed material: Identify the specific material that was removed or disabled and where it appeared before it was removed or disabled.
  2. Statement of consent: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found.
  3. Statement of good faith: Include a statement that you will accept service of process from the party that filed the original DMCA complaint or an agent of that party.
  4. Statement of mistake or misidentification: Include a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  5. Signature: A physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a lawsuit within 10 business days, we will restore the removed material.

Termination of Repeat Infringers

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
